WeGo Group General Terms and Conditions for Sale
Price/Payment
- Prices in the price list are based on the date of quotation. WeGo Group reserves the right to increase prices, and the customer must pay the new prices quoted.
- A customer may be granted installment payment terms, subject to separate approval from WeGo Group. When the final payment is made within six months, the customer will receive the product from WeGo Group.
- Direct bank deposits/Mpesa or cheque payments are acceptable by the WeGo group, and products are released once the payment has been reflected in the WeGo Group’s account.
- Product fees and other fees, including VAT, must be cleared before the order is shipped to the customer.
Orders
- WeGo Group may, upon request by the customer, issue a quotation with respect to the product the customer wishes to purchase
- The customer must ma ake written/verbal order (Order) with WeGo to purchase any material
- Orders must get WeGo group written approval (Order confirmation) before the product is confirmed for shipment
- Orders from customers who pay in installments will be based on the prices, shipping rates, and other conditions officially announced when the last payment is made.
- Factory orders are non-cancellable and non-amendable.
- Orders from customers who pay cash will be accepted at the price, shipping rates, and other conditions officially announced when the customer pays for the order in full.
Return
WeGo Group does not accept returns. The customer’s selections are theirs only, and they are responsible for them. WeGo Group will not accept the return or replacement of materials chosen by the customer, nor will we be responsible for the choice made by the customer.
Claims
Claims of shortcomings of products are made immediately upon receipt of the consignment. WeGo Group will accept no claims after the delivery of the goods.
WARRANTY AND LIMITATIONS
WeGo Group will deliver materials according to specifications and/or order confirmation requirements. WeGo makes no express or implied warranties about workmanship or material fitness. This is true whether or not WeGo knows the purpose and whether or not it was asked for.
Deliveries
- Unless otherwise agreed, delivery dates or periods are best estimates to help the customer plan operations. Delivery times are not binding, and delays do not warrant compensation of any kind.
- When the truck enters where a customer’s premises or premises are not immediately accessible, it should be noted unless the agreed point of delivery is the customer’s site; When WeGo delivers the materials and notifies the customer and the customer delays, fails, refuses, or neglects to accept delivery the shipment is deemed delivered.
- For uncollected material after the delivery date, WeGo Group may charge storage and handling fees.
RISK AND OWNERSHIP TRANSFER
- Materials belong to WeGo Group until delivery is made or deemed made. Loss or damage to delivered goods falls to the customer.
- Factory transport contractor and/or driver must deliver material at customer’s premises or special location and is not obligated to offload the goods.
Indemnity and undertakings
- The customer shall agree to indemnify and protect the WeGo group, and the WeGo group will be defended from legal costs, liability, damages, or expenses, including third-party costs.
FORCE MAJEURE
In the event of an act of God, war, strikes, breakdown of plants or machinery at WeGo Group plants, riots, civil war, operational disaster, heavy rains or floods that make roads impassable, or similar circumstances or actions that are beyond or outside the reasonable control and prevent WeGo from supplying any material or otherwise fulfilling any one or more of its obligations under these General Terms. WeGo Group is relieved of such obligations to the extent of Force Majeure and is not liable for direct or indirect losses and/or damage caused by Force Majeure, provided they always notify the customer of Force Majeure promptly.
Entire agreement Variation
This document contains the entire agreement between the parties. Any change to the General Conditions of Sale must be in writing and sighed by the Director of the WeGo group, or it is null and void.
